Thượng hội đồng không được yêu cầu để quyết định về vấn đề này. Nhưng giả thiết về các cuộc hôn nhân thứ hai nay đã có đầy đủ quyền công dân tại cuộc hội nghị thượng đỉnh của Giáo hội. Bài phê bình của hồng y Camillo Ruini.

 

ROMA, ngày 13 tháng Mười năm 2014 – Sau tuần lễ nhóm họp đầu tiên của thượng hội đồng, có một điều trở nên rõ ràng: chủ đích thực sự cuộc bàn cãi là có chấp nhận ly dị trong hôn nhân Công giáo hay không.

Trong thượng hội đồng, ly dị là một từ bị kiêng kỵ. Không ai cho rằng thượng hội đồng lại bàn đến điểm ấy. Ai nấy đều cả tiếng tuyên bố rằng giáo lý về tính bất khả phân ly phải được giữ nguyên vẹn.

Nhưng khi bàn đến việc có cho người ly dị và tái hôn được rước lễ không, sự thể lại như là, trong trường hợp này, mối giây liên kết thánh thiêng của hôn nhân dường như không còn hiện hữu nữa. Giáo hội Công giáo cũng nên nhìn nhận có cuộc hôn nhân thứ hai, như các Giáo hội Chính Thống đã từng.

Việc này chính là điểm tiên phong do những người đề xướng canh tân cổ xúy lên, không như một phong trào không chút thực tế ủng hộ việc ly dị trong Công giáo, vốn chỉ có một ít nhà thần học như Andrea Grillo hay Hermann Häring minh nhiên đề xướng, nhưng như một đề nghị giúp đỡ mang tính thương xót dành cho những người bị từ khước không được phép rước lễ vì họ đã tái hôn bên dân sự, sau khi đã phá vỡ giây liên kết của bí tích hôn phối bên dân sự.

Đề nghị này hấp dẫn. Nó được đưa ra như một phương thuốc cho những ai đau khổ vì “quyền” lãnh nhận bí tích bị từ khước. Không quan trọng là số lượng các trường hợp như thế rất ít. Nhưng cũng đủ để nó hoạt động như một đòn bẩy, dẫn đến một thay đổi mà các hậu quả hứa hẹn sẽ lớn hơn rất nhiều.

Xã hội học về tôn giáo hẳn cũng có nhiều điều phải nói về khía cạnh này. Mãi đến giữa thế kỷ 20, trong các giáo xứ Công giáo, việc cấm những người ở trong tình trạng hôn phối rối rắm không được chịu lễ chẳng tạo nên một vấn đề nào, vì gần như chẳng ai nhận ra. Vì cho dù số người dự lễ đông, nhưng chỉ ít người rước lễ ngày Chúa Nhật. Chỉ những ai thường xuyên xưng tội mới thường xuyên chịu lễ. Chứng cớ cho việc này là một điều răn có hai mặt mà Giáo hội đã buộc các giáo hữu: xưng tội “một năm ít là một lần” và rước lễ “trong Mùa Phục Sinh.”

Như thế, việc không rước lễ không phải là một dấu chứng bị phạt hay bị loại trừ. Động lực chính khiến các tín hữu không thường xuyên rước lễ, là lòng tôn kính rất mực dành cho bí tích Thánh Thể, chỉ có thể tiếp cận sau khi đã chuẩn bị cặn kẽ, luôn luôn với lòng kính úy và trong run sợ.

Tất cả những chuyện này đã thay đổi trong thời Công Đồng Vaticanô đê Nhị và thời hậu công đồng. Tắt một lời, việc xưng tội gia tăng và việc rước lễ trở thành một hiện tượng quần chúng ồ ạt. Bây giờ, mỗi người, hay hầu như mọi người, đều luôn luôn rước lễ. Vì trong thời gian đó, sự hiểu biết về bí tích Thánh Thể đã thay đổi. Sự hiện diện thực sự của Mình và Máu Chúa Giêsu trong bánh và rượu được truyền phép đã giản lược thành chỉ còn sự hiện diện tượng trưng. Việc rước lễ trở thành giống như một dấu hiệu bình an, một cử chỉ của tình bạn, chia sẻ hay huynh đệ, “giống như người ta hay nói: mọi người khác đi, tôi cũng đi,” như đức giáo hoàng Biển Đức XVI đã nói. Ngài là người cố gắng tái lập ý nghĩa đích thực của Thánh Thể bằng cách muốn – giữa nhiều việc khác nữa – các tín hữu phải quỳ gối và chịu lễ bằng lưỡi.

Trong một bối cảnh như thế, không thể tránh được rằng việc cấm người ly dị và tái hôn rước lễ được xem như một từ chối công khai “quyền” một người được lãnh nhận bí tích. Chuyện phản đối đã và đang là việc của một số ít, vì đa số những người ly dị và tái hôn đều là những người ít sinh hoạt tôn giáo, trong khi giữa những người sống đạo, lại không thiếu những người hiểu và tôn trọng luật lệ của Giáo hội. Nhưng trong số rất nhỏ các trường hợp, bắt đầu từ thập niên 1990, và chủ yếu trong một ít các địa phận nói tiếng Đức, đã nảy sinh một chiến dịch nhằm thay đổi luật lệ của Giáo Hội Công giáo trong lãnh vực hôn phối. Phong trào này đạt cao điểm dưới triều giáo hoàng Phanxicô với sự đồng tình rõ ràng của ngài.

Sự chú tâm của thượng hội đồng vào vấn đề người ly dị và tái hôn cũng có nguy cơ làm mất đi sự chú mục vào những tình hình đang gặp khủng hoảng vĩ mô hơn trong hôn nhân Công giáo.

Chẳng hạn, trong thời gian ngắn ngay trước thượng hội đồng, trên các sạp báo tại Ý, xuất hiện một bản báo cáo về các hoạt động mục vụ do Jorge Mario Bergoglio, hồi đó còn là hồng y, thiết lập nên trong các vùng ngoại ô của Buenos Aires:

Theo bản báo cáo này, người ta biết được rằng, hầu hết các cặp vợ chồng, có khoảng từ 80 đến 85 phần trăm, không cưới xin mà chỉ sống chung, trong khi trong số các cặp vợ chồng, “đa số các cuộc hôn nhân đều bất thành, vì họ cưới nhau khi chưa trưởng thành,” mà họ cũng chắng màng tìm cách có được tuyên bố tiêu hôn từ toà án giáo phận.

Và các ngài đưa ra bằng chứng, không phải của một thành công, nhưng chỉ là một điều nói lên sự thiếu vắng hay thất bại trong việc chăm sóc mục vụ hôn nhân. Tại các châu lục khác, hôn nhân Công giáo cũng bị nằm trong thế kìm kẹp của những thách đố không kém trầm trọng, từ đa thê cho đến hôn nhân cưỡng ép, từ lý thuyết về “giới tính” cho đến các cuộc hôn nhân “đồng tính.”

Đối mặt với một thách đố như thế, thượng hôi đồng này và thượng hội đồng kế tiếp sẽ quyết định xem câu trả lời thích hợp sẽ là mở một lối thoát cho việc ly dị, hay tái xác lập sức mạnh và vẻ đẹp đặc biệt, đầy cách mạng của tính bất khả phân ly trong hôn nhân Công giáo.

Sau đây là phần đóng góp vào cuộc tranh luận, không phải của một nghị phụ trong thượng hội đồng, nhưng của một hồng y Giáo hội Công Giáo Rôma, cảm thấy có bổn phận không thể im hơi lặng tiếng.

The Gospel of the Family in the Secularized West

That fundamental cell of society which is the family is going through a period of extraordinarily rapid evolution.

Premarital relationships are now lived out in the open and divorce is almost normal, often as a result of the breaking of conjugal fidelity. This is pulling us away from the traditional physiognomy of the family, in countries and cultures marked by Christianity.

In recent decades moreover, at least in the EWest, we have entered into unexplored territory. Inroads have been made, in fact, by the ideas of “gender” and of “homosexual marriage.”

At the root of all of this is the primacy, and almost the absolutization, of individual freedom and of personal sentiment. So the family bond must be capable of being molded at will, and in any case not binding, to the point of disappearing or becoming practically irrelevant.

According to the same logic, this bond must be accessible to every kind of couple, on the basis of the assertion of a complete equality that admits no differences, above all those that can be attributed to an external will, whether this be human (civil laws) or divine (the natural law).

The desire to have a family and if possible a stable family, however, remains strong and widespread: a desire that is translated into the reality of many “normal” families and also numerous authentically Christian families. These last are certainly a minority, but substantial and rather motivated.

The sense that the family properly understood is disappearing is therefore to a large extent the result of the distance between the real world and the virtual world constructed by the media, although it must not be forgotten that this virtual world has a powerful influence on real behavior.

In a serene and balanced view, therefore, there seems to be little foundation for unilateral pessimism and resignation with regard to the family and its future. What the pastoral care of the family needs instead is the attitude of Vatican Council II toward the new times, an attitude that we can summarize as a spirit of welcome that redirects everything toward Christ the savior.

In concrete terms, with “Gaudium et Spes” nos. 47-52 we have a new approach to marriage and the family, more personalistic but with no rupture from the traditional conception. Then the catecheses on human love by Saint John Paul II and the apostolic exhortation “Familiaris Consortio” constituted a great exploration that opened new perspectives and confronted many current problems. Although these catecheses could not explicitly deal with more recent and more radical developments, like “gender” theory and same-sex marriage, they already laid the foundations, to a large extent, for addressing them.

Without a doubt, pastoral practice has not always lived up to these teachings – and moreover could never do so completely – but it has followed their guidelines with important results: our young Christian families, in fact, are also the fruit of these.

Now, with Pope Francis, we have two synods on the pastoral challenges of the family in the context of the new evangelization, after the consistory of last February that already began to examine this topic: a further step in this journey of welcoming and reorientation that the whole Church is called to undertake with trust.

The perspective of the two synods must be clearly universal, and no geographical or cultural area can demand that the synod concentrate only on its own problems.

Having established that, the most significant questions for the West seem to be the more radical ones that have emerged in recent decades. These urge us to rethink and to present anew, in the light of the Gospel of the family, the meaning and value of marriage as a covenant of life between man and woman, oriented to the good of both and to the procreation and education of children, and endowed with a decisive social and public significance as well.

Here the Christian faith must demonstrate true cultural creativity, which the synods are not able to produce automatically but can stimulate, in believers and in those who realize that what is at stake is a fundamental human dimension.

But there are other questions that continue to confront us and seem to become ever more urgent, already repeatedly addressed by the magisterium. Among these is that of the divorced and remarried.

“Familiaris Consortio,” no. 84, has already indicated the attitude to adopt: not to abandon those who find themselves in this situation, but on the contrary to take special care of them, striving to make the Church’s means of salvation available to them. This means helping them not to consider themselves separate from the Church by any means, and instead to participate in its life. It also means carefully discerning the situations, especially those of unjustly abandoned spouses as opposed to those who have culpably destroyed their own marriage.

“Familiaris Consortio” however also reiterates the practice of the Church, “which is based upon Sacred Scripture, of not admitting to Eucharistic Communion divorced persons who have remarried.” The fundamental reason is that “their state and condition of life objectively contradict that union of love between Christ and the Church which is signified and effected by the Eucharist.”

What is in question is therefore not their personal blame, but the state in which they objectively find themselves. This is why a man and woman who for serious reasons, like for example the raising of children, cannot satisfy the obligation of separation, in order to receive sacramental absolution and the Eucharist must take on “the duty to live in complete continence, that is, by abstinence from the acts proper to married couples.”

This is undoubtedly a very difficult commitment, which is taken on by very few couples, while the divorced and remarried are unfortunately ever more numerous.

A search for other solutions has therefore been underway for some time. One of these, while holding firm the indissolubility of ratified and consummated marriage, maintains that the divorced and remarried could be allowed to receive sacramental absolution and the Eucharist under precise conditions but without having to abstain from the acts proper to spouses. This would amount to a second table of salvation, offered on the basis of the criterion of “epicheia” in order to unite truth and mercy.

This way does not seem viable, however, mainly because it implies an exercise of extramarital sexuality, given the continuation of the first marriage, ratified and consummated. In other words, the original conjugal bond would continue to exist, but in the behavior of the faithful and in liturgical life one could proceed as if it did not exist. We are therefore facing a question of consistency between practice and doctrine, and not only a disciplinary problem.

As for canonical “epicheia” and “aequitas,” these are very important criteria in the area of human and purely ecclesial norms, but they cannot be applied to the norms of divine law, over which the Church has no discretional power.

In support of the aforementioned hypothesis one can certainly bring in solutions similar to those proposed by some Fathers of the Church that have also entered into practice to some extent, although these never obtained the consensus of the Fathers and were never in any way the common doctrine or discipline of the Church (cf. the letter of the congregation for the doctrine of the faith to the bishops of the Catholic Church on the reception of Eucharistic communion on the part of the divorced and remarried faithful, November 14, 1994, no.4). In our time, when the problem of civil marriage and divorce has been raised in contemporary terms, there exists instead, starting with the encyclical “Casti Connubi” of Pius XI, a clear and constant position of the whole magisterium, which goes in the opposite direction and does not appear modifiable.

It could be objected that Vatican Council II, without violating the dogmatic tradition, proceeded with new developments on questions, like that of religious freedom, on which there existed encyclicals and decisions of the Holy Office that seemed to preclude them.

But the comparison is not convincing, because a genuine conceptual elaboration was produced on the right to religious freedom, attributing this right to the person as such and to his intrinsic dignity, and not to the truth as conceived of abstractly, as had been done before.

The solution proposed for the divorced and remarried, however, is not based on such an elaboration. The problems of family and marriage also impact the daily life of persons in an incomparably greater and more concrete manner compared to that of the foundation of religious freedom, whose exercise in countries of Christian tradition was already guaranteed to a large extent before Vatican II.

We must therefore be very prudent in modifying, with regard to marriage and the family, positions that the magisterium has proposed for a long time and in such an authoritative manner: if not, the consequences for the Church’s credibility would be rather heavy.

This does not mean that every possibility of development is precluded. One way that appears viable is that of revising the processes of nullifying marriages: these are in fact norms of ecclesial law, not divine.

There must therefore be an examination of the possibility of replacing the judicial process with an administrative and pastoral procedure, essentially aimed at clarifying the situation of the couple before God and the Church. It is very important, however, that any change of procedure must not become a pretext for granting in a surreptitious manner what in reality would be divorces: hypocrisy of this nature would bring great harm to the whole Church.

One question that goes beyond the procedural aspects is that of the relationship between the faith of those who marry and the sacrament of marriage.

“Familiaris Consortio,” no. 68, rightly places the accent on the reasons that induce one to maintain that those asking for canonical marriage have faith, albeit in a weakened condition that must be rediscovered, strengthened, and matured. It also emphasizes that social reasons can licitly enter into the request for this form of marriage. It is therefore sufficient that the engaged couple “at least implicitly consent to what the Church intends to do when she celebrates marriage.”

The attempt to establish further criteria of admission to the celebration, which would take into account the level of faith on the part of those to be married, would instead involve grave risks, starting with that of pronouncing unfounded and discriminatory judgments.

In fact, however, there are unfortunately many baptized today who have never believed or no longer believe in God. This therefore raises the question of whether they can validly contract a sacramental marriage.

On this point, Cardinal Ratzinger’s introduction to the booklet “On pastoral care for the divorced and remarried,” published in 1998 by the congregation for the doctrine of the faith, retains its fundamental value.

Ratzinger (Introduction, III, 4, pp. 27-28) maintains that it must be clarified “whether every marriage between two baptized persons is ipso facto a sacramental marriage.” The Code of Canon Law affirms this (can. 1055 § 2) but, as Ratzinger observes, the Code itself says that this applies to a valid marriage contract, and in this case it is precisely the validity that is in question. Ratzinger adds: “Faith belongs to the essence of the sacrament; what remains to be clarified is the juridical question of what evidence of the ‘absence of faith’ would have as a consequence that the sacrament does not come into being.”

It therefore seems to have been established that if there truly is no faith, neither is there the sacrament of marriage.

With regard to implicit faith the scholastic tradition, with reference to Hebrews 11:6 (“anyone who approaches God must believe that he exists and that he rewards those who seek him”), requires at least faith in God as rewarder and savior.

It seems to me, however, that this tradition must be updated in the light of the teaching of Vatican II, on the basis of which the salvation that requires faith can also be obtained by “all men of good will in whose hearts grace is invisibly at work,” including those who maintain that they are atheists or in any case have not come to an explicit knowledge of God (cf. “Gaudium et Spes,” 22; “Lumen Gentium,” 16).

In any event, this teaching of the Council by no means implies an automatism of salvation and a trivialization of the need for faith: it instead places the accent not on an abstract intellectual recognition of God but rather on an adherence, however implicit, of him as the fundamental choice of our life.

In the light of this criterion, it could perhaps be maintained that under the current circumstances there are more baptized persons who do not have faith and therefore cannot validly contract sacramental marriage.

It therefore seems truly opportune and urgent to strive to clarify the juridical question of that “evidence of lack of faith” which would make sacramental marriages invalid and prevent nonbelieving baptized persons from contracting such marriages in the future.

We must not conceal the fact, on the other hand, that this opens the way for much more profound and difficult changes, not only for the Church’s pastoral care but also for the situation of nonbelieving baptized persons.

It is clear, in fact, that like every person they have the right to marriage, which they would contract in civil form. The greatest difficulty does not lie in the danger of compromising the relationship between the canonical order and the civil order: their synergy has already become very weak and problematic, through the progressive distancing of civil marriage from what are the essential requisites of natural marriage itself.

The effort of Christians and of those who are aware of the human and social importance of the family founded on marriage should instead be aimed at helping the men and women of today to rediscover the significance of those requisites. They are founded on the order of creation and precisely for this reason apply to every age and can be made concrete in forms adapted to the most diverse times.

I would like to end by recalling the common intention that animates those who are taking part in the synodal debate: to hold together, in pastoral care for the family, the truth of God and of man with the merciful love of God for us, which is the heart of the Gospel.

L’Évangile de la famille dans l’Occident sécularisé

Cette cellule fondamentale de la société qu’est la famille est en train de traverser une période d’évolution extraordinairement rapide.

Désormais les rapports sexuels avant le mariage sont considérés comme une évidence et les divorces comme étant presque normaux, très souvent comme une conséquence de la rupture de la fidélité conjugale. Nous nous éloignons ainsi de la physionomie traditionnelle de la famille, dans les pays et dans les civilisations marqués par le christianisme.

D’autre part, au cours de ces dernières décennies, nous sommes entrés, au moins en Occident, dans des territoires inexplorés. En effet la question du “gender” et celle des “mariages homosexuels” ont fait leur chemin.

À la racine de tout cela, il y a la primauté, et presque l’absolutisation, de la liberté individuelle et du sentiment personnel. Voilà pourquoi le lien familial doit être malléable à volonté et, en tout cas, ne pas être contraignant, au point de disparaître ou d’être pratiquement insignifiant.

Selon la même logique, ce lien doit être accessible à toutes les sortes de couples, sur la base de la revendication d’une égalité totale qui n’accepte pas les différences, en particulier celles qui trouvent leur origine dans une volonté extérieure, que celle-ci soit humaine (le droit civil) ou divine (le droit naturel).

Cependant, le désir d’avoir une famille – et autant que possible une famille stable – reste fort et largement répandu. C’est un désir qui se traduit dans la réalité d’innombrables familles “normales” et également dans celle de nombreuses familles authentiquement chrétiennes. Certes ces dernières sont une minorité, mais elle est consistante et très motivée.

La sensation que la famille au sens propre est actuellement en train de disparaître est donc, pour une bonne part, le résultat de la distance qui existe entre le monde réel et le monde virtuel construit par les moyens de communication, même s’il ne faut pas oublier que ce monde virtuel a une influence très forte sur les comportements réels.

Par conséquent, si l’on porte sur cette question un regard serein et équilibré, le pessimisme unilatéral et la résignation paraissent peu fondés en ce qui concerne la famille et son avenir. On peut plutôt considérer que l’attitude du concile Vatican II vis-à-vis des temps nouveaux – attitude que l’on peut résumer par le binôme accueil/réorientation vers le Christ sauveur – est également applicable à la pastorale de la famille.

Concrètement, on trouve dans “Gaudium et spes” (n° 47-52), en ce qui concerne le mariage et la famille, une nouvelle approche, nettement plus personnaliste mais sans rupture avec la conception traditionnelle. Ensuite les catéchèses de saint Jean-Paul II relatives à l’amour humain et l’exhortation apostolique “Familiaris consortio” ont constitué un grand approfondissement, qui ouvre de nouvelles perspectives et aborde un grand nombre des problèmes actuels. Même si ces catéchèses n’ont pas eu la possibilité d’affronter de manière explicite les développements les plus récents et les plus radicaux, tels que la théorie du “gender” et le mariage entre personnes de même sexe, elles ont en tout cas posé, dans une large mesure, les bases permettant de les affronter.

Il est indubitable que la pratique pastorale n’a pas toujours été à la hauteur de ces enseignements – et, du reste, elle ne peut jamais l’être complètement – mais elle a opéré en suivant la ligne qu’ils définissent et elle est parvenue à des résultats importants : en effet nos jeunes familles chrétiennes sont également dues à son action.

Maintenant, avec le pape François, nous avons deux synodes consacrés aux défis pastoraux relatifs à la famille dans le contexte de la nouvelle évangélisation, après le consistoire du mois de février dernier qui avait déjà abordé ce sujet : il s’agit d’une étape supplémentaire dans cette démarche d’accueil et de réorientation que l’Église tout entière est appelée à entreprendre avec confiance.

Ces deux synodes doivent être conçus dans une optique clairement universelle et il n’y a aucun secteur géographique ou culturel qui puisse exiger que les synodes se concentrent uniquement sur ses propres problèmes.

Cela posé, les questions les plus significatives, pour l’Occident, semblent être celles, plus radicales, qui sont apparues au cours de ces dernières décennies. Elles incitent à repenser et à réexpliquer, à la lumière de l’Évangile de la famille, la signification et la valeur du mariage en tant qu’alliance pour la vie entre l’homme et la femme, une alliance orientée vers le bien des époux et vers la mise au monde et l’éducation des enfants et également dotée d’une importance décisive aux points de vue social et public.

Sur ce point la foi chrétienne doit faire preuve d’une véritable créativité culturelle, que les synodes ne peuvent pas produire automatiquement mais qu’ils peuvent stimuler, chez les croyants et chez ceux qui se rendent compte que ce qui est en jeu, c’est une dimension humaine fondamentale.

Cependant il y a égalementi d’autres questions qui ont déjà été traitées à de multiples reprises par le magistère mais qui continuent à nous interpeller et qui semblent se poser de manière de plus en plus aigüe. L’une de ces questions est celle des divorcés remariés.

“Familiaris consortio” a déjà indiqué (n° 84) quel est le comportement qu’il convient d’adopter : ne pas abandonner ceux qui se trouvent dans cette situation, mais au contraire prendre spécialement soin d’eux, en s’appliquant à mettre à leur disposition les moyens de salut de l’Église. Par conséquent, les aider à ne pas se considérer comme complètement séparés de l’Église et, au contraire, les aider à participer à sa vie. Il faut bien discerner, par ailleurs, les situations et en particulier distinguer les époux qui ont été abandonnés injustement de ceux qui, eux, sont coupables d’avoir détruit leur mariage.

Cependant cette même exhortation apostolique “Familiaris consortio” réaffirme la pratique de l’Église, “fondée sur la Sainte Écriture, consistant à ne pas permettre l’accès des divorcés remariés à la communion eucharistique”. La raison fondamentale de cette pratique est que “leur état et leur mode de vie sont objectivement en contradiction avec cette union d’amour entre le Christ et l’Église qui est signifiée et réalisée par l’Eucharistie”.

Ce qui est en question, par conséquent, ce n’est pas une faute personnelle qu’ils ont commise, mais l’état dans lequel ils se trouvent objectivement. C’est pourquoi l’homme et la femme qui ne peuvent pas, pour des raisons sérieuses telles que, par exemple, l’éducation de leurs enfants, se soumettre à l’obligation de vivre séparés, afin de pouvoir recevoir l’absolution sacramentelle et s’approcher de l’Eucharistie, doivent prendre “l’engagement de vivre dans une complète chasteté, c’est-à-dire de s’abstenir des actes propres aux époux”.

Il s’agit là, indubitablement, d’un engagement très difficile qui, de fait, n’est pris que par très peu de couples, alors que les divorcés remariés sont, malheureusement, de plus en plus nombreux.

C’est pourquoi, depuis longtemps, on cherche d’autres solutions. L’une d’elles, tout en maintenant fermement l’indissolubilité du mariage conclu et consommé, considère qu’il est possible de permettre aux divorcés remariés de recevoir l’absolution sacramentelle et de s’approcher de l’Eucharistie, à des conditions précises mais sans qu’ils soient obligés de s’abstenir des actes propres aux époux. Il s’agirait d’une seconde planche de salut, offerte sur la base du critère de l’”epicheia” afin de joindre la miséricorde à la vérité.

Cependant il ne semble pas que cette solution puisse être utilisée, principalement parce qu’elle implique un exercice de la sexualité extraconjugale, étant donné que le premier mariage, qui a été conclu et consommé, perdure. En d’autres termes, le lien conjugal originel continuerait à exister mais, pour ce qui est du comportement des fidèles et dans la vie liturgique, il serait possible de procéder comme s’il n’existait pas. Nous sommes donc confrontés, avec cette solution, à un problème de cohérence entre la pratique et la doctrine, et pas seulement à un problème disciplinaire.

Quant à l’”epicheia” et à l’”æquitas” canonique, ce sont des critères très importants dans le domaine des normes humaines et purement ecclésiales, mais elles ne peuvent pas être appliquées aux normes de droit divin, sur lesquelles l’Église n’a aucun pouvoir discrétionnaire.

À l’appui de l’hypothèse que nous venons d’évoquer, on peut certainement citer des solutions pastorales analogues à celles qui ont été proposées par certains Pères de l’Église et qui sont également entrées, jusqu’à un certain point, dans la pratique, mais elles n’ont jamais obtenu l’accord des Pères et elles n’ont été en aucune manière la doctrine ou la discipline commune de l’Église (cf. la lettre adressée par la congrégation pour la doctrine de la foi aux évêques de l’Église catholique à propos de la distribution de la communion eucharistique aux fidèles divorcés et remariés, 14 novembre 1994, n° 4). À notre époque où, en raison de l’introduction du mariage civil et du divorce, le problème s’est posé dans les termes actuels, il existe au contraire, à partir de l’encyclique “Casti connubii” de Pie XI, une position commune du magistère, claire et constante, qui va dans le sens contraire et qui ne semble pas pouvoir être modifiée.

On pourrait objecter que le concile Vatican II a procédé, sans violer la tradition dogmatique, à de nouveaux développements concernant des questions, telles que celle de la liberté religieuse, à propos desquelles il existait des encycliques et des décisions du Saint-Office qui paraissaient les exclure.

Mais cette comparaison n’est pas convaincante parce qu’un véritable approfondissement conceptuel a été réalisé en ce qui concerne le droit à la liberté religieuse et qu’il a rattaché ce droit à l’être humain en tant que tel et à sa dignité intrinsèque, et non plus à la vérité conçue de manière abstraite, comme on le faisait précédemment.

La solution proposée en ce qui concerne les divorcés remariés n’est pas fondée, quant à elle, sur un approfondissement de ce genre. D’autre part les problèmes relatifs à la famille et au mariage influent sur la vie quotidienne des personnes d’une manière incomparablement plus forte et concrète que ceux qui ont trait à l’établissement de la liberté religieuse, l’exercice de cette dernière étant, en tout cas, déjà assuré dans une large mesure dès avant Vatican II dans les pays de tradition chrétienne.

Il faut donc que nous soyons très prudents lorsqu’il est question d’apporter des modifications, en ce qui concerne le mariage et la famille, aux positions qui sont proposées par le magistère depuis longtemps et d’une manière qui fait autorité : dans le cas contraire, les conséquences quant à la crédibilité de l’Église seraient très graves.

Cela ne veut pas dire que toutes les possibilités de développement soient exclues. Une voie qui pourrait, semble-t-il, être envisagée est celle de la révision des procès en nullité du mariage : il s’agit là, en effet, de normes qui sont de droit ecclésial et non pas divin.

Il s’agit donc d’examiner s’il est possible de remplacer le processus judiciaire par une procédure administrative et pastorale, qui serait destinée essentiellement à clarifier la situation du couple devant Dieu et devant l’Église. Toutefois il est très important que tout changement de procédure, quel qu’il soit, ne devienne pas un prétexte pour concéder, de manière subreptice, ce qui serait en réalité un divorce : une hypocrisie de ce genre causerait un tort très grave à l’Église tout entière.

Une question qui va au-delà des aspects de procédure est celle du rapport entre la foi de ceux qui se marient et le sacrement du mariage.

“Familiaris consortio” (n° 68) met à juste titre l’accent sur les raisons qui conduisent à considérer que les gens qui demandent à contracter un mariage canonique ont la foi, même si celle-ci est faible et nécessite une redécouverte, un renforcement et un mûrissement. L’exhortation apostolique souligne par ailleurs que des raisons sociales peuvent entrer, de manière licite, dans la demande de cette forme de mariage. Par conséquent il est suffisant que les fiancés “au moins implicitement, consentent à ce que l’Église entend faire lorsqu’elle célèbre le mariage”.

En revanche vouloir ajouter des critères supplémentaires d’admission à la célébration, qui concerneraient le degré de foi des candidats au mariage, comporterait des risques graves, à commencer par celui de prononcer des jugements infondés et discriminatoires.

Cependant c’est un fait qu’il y a aujourd’hui, malheureusement, un grand nombre de baptisés qui n’ont jamais cru, ou qui ne croient plus, en Dieu. La question se pose donc de savoir si ces personnes peuvent contracter de manière valide un mariage sacramentel.

Sur ce point, il y a un texte qui conserve une valeur fondamentale : c’est l’introduction qui avait été rédigée par le cardinal Ratzinger pour le petit livre intitulé “Sur la pastorale des divorcés remariés”, qu’avait publié en 1998 la congrégation pour la doctrine de la foi.

Ratzinger considère (Introduction, III, 4, pp. 27-28) qu’il faut décider clairement “si vraiment tout mariage entre deux baptisés est ‘ipso facto’ un mariage sacramentel”. Le Code de droit canonique affirme que oui (canon 1055, § 2) mais, comme le fait remarquer Ratzinger, le Code lui-même dit que cela s’applique à un mariage contracté de manière valide ; or, dans ce cas, c’est précisément la validité qui est mise en question. Et Ratzinger d’ajouter : “La foi appartient à l’essence du sacrement ; il reste à régler le problème juridique de savoir quelle évidence de ‘non-foi’ aurait comme conséquence qu’un sacrement ne se réalise pas”.

Par conséquent il semble bien établi que, s’il n’y a vraiment pas de foi, il n’y a pas non plus de sacrement du mariage.

En ce qui concerne la foi implicite, la tradition scholastique, faisant référence à He 11, 6 (“Celui qui s’approche de Dieu doit croire qu’Il existe et qu’Il se fait le rémunérateur de ceux qui Le cherchent”), demande que l’on ait au moins la foi en Dieu rémunérateur et sauveur.

Cependant il me semble qu’il faudrait que cette tradition fasse l’objet d’une mise à jour, à la lumière de l’enseignement de Vatican II, sur la base duquel “tous les hommes de bonne volonté, dans le cœur desquels la grâce travaille d’une manière invisible”, peuvent, eux aussi, parvenir au salut qui demande la foi, y compris ceux qui se considèrent comme athées ou ceux qui, en tout cas, ne sont pas parvenus à une connaissance explicite de Dieu (cf. “Gaudium et spes”, 22 ; “Lumen gentium”, 16).

En tout état de cause, cet enseignement du concile n’implique absolument pas un automatisme du salut et une suppression de la nécessité de la foi : au contraire il met l’accent non pas sur une reconnaissance intellectuelle abstraite de Dieu, mais bien sur une adhésion à lui, si implicite soit-elle, en tant que décision fondamentale de notre vie.

Si l’on tient compte de ce critère, peut-être faut-il considérer que, dans la situation actuelle, les baptisés qui, en fait, n’ont pas la foi et qui, par conséquent, ne peuvent pas contracter de manière valide un mariage sacramentel, sont encore plus nombreux.

Il semble donc qu’il soit véritablement opportun et urgent de s’employer à faire la lumière à propos du problème juridique de cette “évidence de non-foi” qui rendrait non valides les mariages sacramentels et qui, à l’avenir, empêcherait les baptisés non croyants de contracter un tel mariage.

D’autre part nous ne devons pas nous dissimuler que, de la sorte, la voie est ouverte à des changements très profonds et porteurs de nombreuses difficultés, non seulement pour la pastorale de l’Église mais aussi pour la situation des baptisés non croyants.

Il est clair, en effet, que ces derniers ont, comme tout un chacun, le droit de se marier, ce qu’ils feront sous la forme d’un mariage civil. La difficulté la plus importante ne réside pas dans le danger de compromettre le rapport entre le domaine canonique et le domaine civil : en réalité la synergie entre l’un et l’autre est déjà devenue très faible et très problématique, parce que le mariage civil s’est éloigné progressivement de ce qui constitue les exigences essentielles du mariage naturel lui-même.

L’engagement des chrétiens et de toutes les personnes qui sont conscientes de l’importance humaine et sociale de la famille fondée sur le mariage devrait plutôt avoir comme objectif d’aider les hommes et les femmes de notre temps à redécouvrir la signification de ces exigences. Celles-ci reposent sur l’ordre de la création et, précisément pour cette raison, elles gardent leur valeur à toutes les époques et elles peuvent se concrétiser sous des formes qui conviennent aux périodes les plus diverses.

Je voudrais terminer en rappelant l’intention commune qui anime ceux qui interviennent actuellement dans le débat synodal : associer, dans la pastorale de la famille, la vérité de Dieu et de l’homme à l’amour miséricordieux de Dieu pour nous, qui est le cœur de l’Évangile.

Nhân dịp thượng hội đồng lần này, đang xảy ra từ ngày 5 tháng Mười đến ngày 19 tháng Mười, văn phòng báo chí Toà thánh đã lập một trang blog thông tin viết bằng nhiều thứ tiếng, ở địa chỉ sau đây:

Tuy nhiên những đóng góp trên trang blog này đến từ các gom góp hành lang bên ngoài phòng hội mà thôi. Vì có một bức tường không thể vượt qua ngăn chặn những gì đang được nói trong buôi họp lọt được ra ngoài

Sự thể không trong các thượng hội đồng trước đây không như vậy. Mỗi ngày có hai bản thông cáo báo chí được soạn bằng nhiều ngôn ngữ báo cáo về những gì đã phát biểu trong buổi họp, được chính các diễn giả tóm lược.

Tuy vậy, lần này, báo chí chỉ được cung cấp tên của diễn giả, trong khi những điều đã phát biểu chỉ được cha Federico Lombardi báo cáo lại bằng miệng, sau khi đã cẩn thận loại bỏ những gì cho phép đoán ra được ai là diễn giả.

Hậu quả tức khắc tạo ra, là có sự tách biệt thật sự giữa thượng hội đồng thật sự xảy ra, và một thượng hội đồng khác được báo chí dựng lên, với những nhấn mạnh cố ý vào những điểm, những vấn đề thích hợp với thời thế lúc ấy. Sự tách biệt đã từng được chứng kiến nơi Công đồng Vaticanô đệ Nhị, mà đức Biển Đức đã nêu lên rành rọt cách bậc thầy trong lần họp mặt cuối cùng với hàng giáo phẩm Roma, sau khi ngài công bố từ nhiệm:

Một hạn chế nghiêm khắc khác đặt ra cho các nghị phụ năm nay là việc cấm phổ biến bản văn các lời phát biểu. Theo yêu cầu, bản văn viết phải được nộp trình trước ngày 8 tháng Chín vừa qua.

Luật cấm này được hồng y tổng thư ký, Lorenzo Baldisseri, thông báo bằng miệng, vào lúc khai mạc thượng hội đồng. Lý do đưa ra là, một khi đã đệ trình, các bản văn ấy trở thành tài sản riêng của thượng hội đồng.

Trong các thượng hội đồng trước đây, sự thể không như thế. Các nghị phụ không chỉ tóm lược phát biểu của mình, mà các ngài còn có thể công bố trọn vẹn bài phát biểu, nếu muốn.

Vào lúc khai mạc thượng hội đồng, giáo hoàng Phanxicô đã yêu cầu các nghị phụ phải phát bểu trong “parresia,” thẳng thắn và tự do, ma không phải sợ là “đức giáo hoàng có thể nghĩ khác.”

Nhưng người ta chỉ thấy được chính việc trao đổi tự do này, thực sự qua việc làm, trong những tháng trước thượng hội đồng, đối với và đặc biệt chống lại những đề nghị thay đổi của hồng y Walter Kasper, mà người ta được biết có sự đồng thuận của đức giáo hoàng

Nhưng chỉ có điều lạ là, chính Kasper và những vị ủng hộ ông lại tỏ ra không bao dung với những chỉ trích nhắm đến mình, nhất là khi các chỉ trích ấy đến từ các vị hồng y cấp cao như Gerhard L. Müller, bộ trưởng bộ giáo lý đức tin.

Trong khi thượng hội đồng diễn tiến, hồng y Müller đã yêu cầu các bản văn những nhận xét của các nghị phụ trong hội đồng phải được công bố. Nhưng chỉ hoài công.

Vì thế việc giữ kín các thông tin về thượng hội đồng không phải là ý kiến của ngài, cũng chẳng phải của các hồng y giống như ngài, đã kiên trì nhẫn nại bảo vệ cho tính bất khả phân ly của hôn nhân Công giáo.

Người đã muốn và quyết định điều đó, xét cho đến cùng, không thể là ai khác hơn là giáo hoàng.

Người ta cũng gán cho ngài, là người đã thành lập ủy ban viết ra bản “Relatio Synodi – Phúc Trình về Thượng hội đồng.” chung cuộc, mà đa số trong đó đều thuận với việc cho phép người tái hôn bên dân sự được rước lễ:
